Leya Terms of Use

These Terms of Use ("Terms") are the agreement that applies to your Leya account and your use of the Leya apps (mimosa, Lotus, Trellis, any apps added later, and leyaproduction.com). By tapping "Accept and Create Account" when you create your account, you confirm that you have read and accept these Terms. If you don't accept them, don't create an account or use the Leya apps.

1. Who we are

Provider: Leya Production, a brand operated by Yusuf Melih Bozgeyik ("Leya", "we", "us"). Contact: support@leyaproduction.com

User: the person who creates a Leya account and uses the Leya apps ("you").

2. Your Leya account

1. You need a Leya account to use the Leya apps. You create it by signing in with your Apple or Google account. We never see your Apple or Google password.
2. Your account is yours alone. You may not share, sell, rent or transfer it. You are responsible for what happens in your account.
3. Give accurate information when you create your account. You may not use a name or username that impersonates another person, an organization or Leya.
4. Usernames may not contain insults, hate speech, obscenity or anything that infringes someone else's trademark. We may change or remove a username that breaks this rule.
5. You can change your username once every 30 days.
6. You must be at least 13 years old to create an account. If you are under 18 (or the age of majority where you live), you may use Leya only with the consent of a parent or guardian.

3. Licence

1. The Leya apps are not sold to you. You receive a personal, non-transferable, non-exclusive and revocable licence to use them for your own personal purposes.
2. All intellectual property rights in the apps' software, design, names (including Leya, Leya Production, mimosa, Lotus, Trellis, MimoBook, MimoBoard, Seeds and Echo), logos and every other element belong to Leya.
3. No right is granted to you that these Terms don't expressly grant.

4. Strictly prohibited

You may not do, attempt to do, or help anyone else do any of the following:

1. Modify, crack, patch or re-sign a Leya app, or use a modified version of one.
2. Try to obtain an app's source code, or reverse engineer, decompile or disassemble it (except where the law expressly allows it).
3. Circumvent, disable or feed false information to licensing, payment, subscription, account or integrity-verification systems.
4. Copy, reproduce, distribute, publish, sell or rent a Leya app or any part of one, or share it anywhere other than the official stores (App Store, Google Play).
5. Use a Leya app together with malware (viruses, trojans, spyware and the like), use it to spread malware, or run tools that deliberately compromise the integrity of your device or the app.
6. Try to gain unauthorized access to Leya's servers, attack them or overload them, or access them with bots, scripts or other automated tools.
7. Use someone else's account, or buy or sell accounts.
8. Use the Leya apps for any unlawful purpose.

5. Security and integrity checks

1. The Leya apps automatically verify that the app being used is genuine and unmodified and that the device can be trusted. Services such as Google Play Integrity, Apple App Attest and Firebase App Check are used for this.
2. These checks keep security records such as an app-specific device identifier, the device model, the app version, the IP address and the results of the checks. The Privacy Notice describes them in detail.
3. By creating an account, you agree to these checks and to the keeping of these security records.

6. What happens if you break these Terms

1. If we detect conduct that breaks these Terms, in particular section 4, Leya may suspend or permanently close your account without prior notice.
2. Suspending or closing your account ends your access to every Leya app (mimosa, Lotus, Trellis and others) and to the account features of leyaproduction.com.
3. If a modified or re-signed app is detected connecting to our servers, the account is suspended automatically.
4. No refunds are given for accounts suspended or closed because of a breach. Subscription refunds are always subject to the App Store's and Google Play's own rules. Your mandatory statutory rights are not affected.
5. Security records and records of accepted agreements relating to a breach are kept as evidence and may be shared with the competent authorities where required.
6. Leya reserves the right to take civil action for compensation and to pursue criminal remedies under applicable copyright and computer crime laws.

7. Appeals

If you believe your account was suspended by mistake, write to support@leyaproduction.com with your username within 30 days of the suspension. We will review your appeal and tell you the outcome. If your account was suspended by mistake, we will restore your access.

8. Subscriptions and purchases

1. Paid features of the Leya apps (such as mimosa Pro) are bought through the App Store or Google Play. Payment, renewal and cancellation are subject to that store's terms.
2. Subscriptions renew automatically at the end of each period unless cancelled. You can cancel at any time in your store account settings.
3. Your purchases are linked to your Leya account, so you can use them on supported devices where you sign in with the same account.
4. Your payment details never reach us; the store processes them.

9. Your content

1. The documents, notes, drawings, recordings and other content you create in or import into the Leya apps belong to you.
2. This content is kept on your device and in the cloud storage you choose (such as iCloud or Google Drive). It is not sent to Leya's servers, and we cannot access it.
3. You are responsible for backing up your content and for making sure it is lawful.

10. The service and our liability

1. We may keep improving and changing the Leya apps and the account service, and we may remove features.
2. The service is provided "as is". We don't guarantee that it will be uninterrupted or error-free.
3. To the extent the law allows, Leya is not liable for indirect loss, loss of data or loss of profit. Liability for intent and gross negligence, and any liability that cannot be excluded by law, is not affected.

11. Deleting your account

1. You can delete your account at any time in the app's Settings. When you do, your profile, your username and the data linked to your account are deleted.
2. Records of accepted agreements and security records are kept for the period stated in the Privacy Notice, to establish, exercise or defend legal claims.
3. The content on your device and in your own cloud storage is not affected by deleting your account.

12. Changes to these Terms

We may update these Terms. When we make a significant change, we will show the new version in the app and ask you to accept it. If you don't accept it, you can delete your account. Every version is archived on leyaproduction.com with its version number.

13. Governing law and disputes

1. These Terms are governed by the laws of the Republic of Türkiye.
2. If you are a consumer, nothing in these Terms takes away the protection of the mandatory consumer laws of the country where you live, or your right to bring a claim before the courts or consumer bodies there.

14. Language

The Turkish version of these Terms is binding for users in Türkiye. This English version is binding for all other users. Summaries and translations in other languages are for information only.
